Rights Project and Americans for Immigrant Justice, argue that this law violates the Supremacy Clause of the U.S. Constitution, as immigration regulation is the exclusive responsibility of the federal government.<\/p>\n<h2><!--more--><\/h2>\n<h2>What does this law establish?<\/h2>\n<figure id=\"attachment_25170\" aria-describedby=\"caption-attachment-25170\" style=\"width: 1200px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-25170\" src=\"https:\/\/queonnda.com\/wp-content\/uploads\/2025\/04\/ley-2.jpg\" alt=\"SB 4C law\" width=\"1200\" height=\"800\" \/><figcaption id=\"caption-attachment-25170\" class=\"wp-caption-text\">PHOTO: Envato<\/figcaption><\/figure>\n<p>SB 4C, which became effective February 13, 2025, imposes automatic criminal penalties for anyone over the age of 18 who enters or re-enters the state of Florida knowing they do not have immigration authorization.<\/p>\n<p>This measure affects even individuals with active asylum applications, Temporary Protected Status (TPS) or with U.S. citizen family members.<\/p>\n<figure class=\"wp-block-pullquote\"><blockquote><p style=\"color: #fd9737;\">This law violates the Supremacy Clause of the U.S. Constitution<\/p><cite>QueOnnda.com<\/cite><\/blockquote><\/figure>\n<p>Under the legislation, any individual in such a situation could face mandatory imprisonment.<\/p>\n<p>This has set off alarm bells in immigrant communities, especially among Hispanics living and working in Florida.<\/p>\n<h2>&#8220;It&#8217;s a cruel law&#8230;&#8221;<\/h2>\n<figure id=\"attachment_25172\" aria-describedby=\"caption-attachment-25172\" style=\"width: 1200px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-25172\" src=\"https:\/\/queonnda.com\/wp-content\/uploads\/2025\/04\/ley-3.jpg\" alt=\"\" width=\"1200\" height=\"800\" \/><figcaption id=\"caption-attachment-25172\" class=\"wp-caption-text\">PHOTO: Envato<\/figcaption><\/figure>\n\n<p>&#8220;This law (SB 4C) strips power from the federal government and gives it to state authorities with no immigration training or jurisdiction,&#8221; stated Bacardi Jackson, executive director of the ACLU of Florida.<\/p>\n<p>&#8220;It threatens to separate families and detain people who have every legal right to be here.&#8221;<\/p>\n<p>The lawsuit was filed on behalf of community organizations such as the Florida Farmworkers Association and the Florida Immigrant Coalition.<\/p>\n<p>As well as immigrants with pending proceedings or family ties to U.S. citizens.<\/p>\n<p>The plaintiffs are asking the federal court to block the implementation of SB 4C to prevent &#8220;further devastation to immigrant communities.&#8221;<\/p>\n<p>Hannah Steinberg, an attorney with the ACLU&#8217;s Immigrants&#8217;
