He had resided in Maryland for more than a decade. In 2019, an immigration judge determined he was deportable, but an asylum judge ordered his deportation stayed due to risk of persecution.<\/p>\n<p>Despite this protection, he was deported in March 2025 for what the State Department recognized as an &#8220;administrative error&#8221;, sending him to El Salvador without the opportunity to appeal, along with more than 200 other migrants. He was interned in the maximum security prison CECOT, where he reported being beaten and tortured.<\/p>\n<h2><!--more--><\/h2>\n<h2>Return to the U.S. and new charges<\/h2>\n<figure id=\"attachment_60550\" aria-describedby=\"caption-attachment-60550\" style=\"width: 1200px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-60550\" src=\"https:\/\/queonnda.com\/wp-content\/uploads\/2025\/07\/kilmar-ga-2.jpg\" alt=\"Kilmar \u00c1brego Garc\u00eda\" width=\"1200\" height=\"800\" \/><figcaption id=\"caption-attachment-60550\" class=\"wp-caption-text\">PHOTO: Agencia Efe<\/figcaption><\/figure>\n<p>After legal and media pressure, Kilmar \u00c1brego Garc\u00eda was brought back to the U.S. in June 2025.<\/p>\n<p>However, he was arrested on criminal charges for a 2022 case in Tennessee, where he allegedly transported undocumented persons.<\/p>\n<p>The defense considers these charges to be retaliation by the government for publicly exposing his wrongful deportation.<\/p>\n<p>He is currently facing charges of conspiracy to transport undocumented persons and illegal transportation for profit.<\/p>\n<p>He pleaded not guilty and remains in custody in Nashville.<\/p>\n<h2>Trial scheduled for January 2026<\/h2>\n<figure id=\"attachment_60556\" aria-describedby=\"caption-attachment-60556\" style=\"width: 1200px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-60556\" src=\"https:\/\/queonnda.com\/wp-content\/uploads\/2025\/07\/kilmar-ga-3.jpg\" alt=\"\" width=\"1200\" height=\"800\" \/><figcaption id=\"caption-attachment-60556\" class=\"wp-caption-text\">PHOTO: Screenshot from WTVR CBS 6 Richmond X Account.<\/figcaption><\/figure>\n\n<p>Federal Judge Waverly D.
