SB 4-C, which was passed in February of this 2025, is one of the strictest state legislations against irregular immigration.<\/p>\n

Criminalizes the entry or re-entry of undocumented persons into Florida, making it a state crime with penalties that can include imprisonment without bail.<\/p>\n

In repeated cases, sanctions may be even more severe.<\/p>\n

For critics and legal experts, this law encroaches on the exclusive powers of the federal government, making it a direct challenge to Washington’s authority in immigration matters.<\/p>\n

Judicial stay and appeals<\/h2>\n

On April 4, 2025, federal Judge Kathleen Williams<\/strong> ordered a temporary stay of enforcement of SB 4-C.<\/p>\n

He noted that it likely violates the Supremacy Clause and the Commerce Clause of the U.S. Constitution.<\/p>\n

Subsequently, the measure was extended with a preliminary injunction, and the Supreme Court<\/a>, on July 9, 2025, rejected the state’s request to apply it immediately, keeping the blockade in place.<\/p>\n

The case is still ongoing and a key hearing is expected in October 2025.<\/p>\n

Arrests despite ban<\/h2>\n

Despite the suspension, arrests under this law were recorded in July 2025.<\/p>\n

Two migrants were arrested in Sarasota County in traffic incidents, although the charges were later dropped.<\/p>\n

These arrests caused Florida Attorney General James Uthmeier to be held in contempt of court for failing to comply with the court order.<\/p>\n

The site can accommodate up to 2,000 people and its legality is in question, as the regulations that supposedly support its operation are suspended.<\/p>\n
