Alert for Venezuelans: U.S. orders more than 250,000 to ‘prepare’ to leave in November

The Department of Homeland Security(DHS) said Friday that the 2021 Temporary Protected Status (TPS) designation will end on November 7, and asked beneficiaries to “prepare” to return to their country if they have no other legal basis to remain in the country.

With this decision, some 267,000 Venezuelans, whose protection initially expired on September 10, gained a small respite thanks to the additional time period established by the regulations, because the law requires the Executive to give at least 60 days’ notice of the termination of TPS, so that beneficiaries have options to avoid remaining in the country irregularly.

Venezuelans asked to prepare

“If you are a foreign national and are currently a beneficiary of TPS for Venezuela under the 2021 designation, you should prepare to return to Venezuela if you have no other legal basis to remain in the United States,” the U.S. Citizenship and Immigration Services (USCIS) said Friday in a statement.

The U.S. Government invited Venezuelans affected by the termination of their immigration benefits to use the CBP Home application if they intend to leave the United States.

Judge to decide future

The immigrants’ hope of staying is in the hands of a federal judge in California who is evaluating a lawsuit filed by a group of affected Venezuelans and the TPS Alliance in which they allege that the termination of the relief by President Donald Trump’s administration is illegal.

The legal action seeks to protect two groups of Venezuelans covered by the TPS granted by former President Biden, those of 2021, some 250,000, and the beneficiaries of the 2023 extension, some 350,000, according to EFE.

TPS immigration benefit revoked

The government of U.S. President Donald Trump decided to revoke on Wednesday the Temporary Protected Status (TPS) granted to Venezuelans in 2021, which leaves a quarter of a million immigrants from that country on the brink of deportation.

The Secretary of Homeland Security (DHS), Kristi Noem, officially announced that she will not extend the protection granted by President Joe Biden’s administration (2021-2025) to nearly 250,000 Venezuelans, which expires on September 10.

TPS grants a work permit and protects beneficiaries from deportation.
