The Department of Homeland Security (DHS) announced Wednesday the end of the automatic extension of employment permits for certain immigrant groups, a move that reverses a policy in place since the previous administration that sought to alleviate application processing delays.

As of October 30, 2025, immigrants applying to renew their work permit will no longer receive an automatic extension while their application is being processed, DHS said in an official statement. The decision is part of an executive order by President Donald Trump, whose stated goal is to strengthen background checks and immigration enforcement for those seeking authorization to work in the United States.

A change that puts an end to the relief policy created in 2024.


During the Joe Biden administration, the government had extended in 2024 the automatic extension period for employment permits from 180 to 540 days, a measure that sought to prevent the loss of employment of thousands of legally authorized immigrants while waiting for the renewal of their document.

At the time, the U.S. Citizenship and Immigration Services (USCIS) was facing a record number of applications, with delays of up to six months in some cases.

This policy allowed employers to keep their workers without interruption and reduced the risk of unjustified dismissals due to administrative delays.

Under the new rule, anyone applying for a renewal after October 30 must wait for formal approval from USCIS before continuing to work legally, except for limited exceptions provided for in the law or in notices published in the Federal Register.

DHS clarified that certain categories, such as Temporary Protected Status (TPS) beneficiaries from countries with existing designations, may retain specific extensions announced publicly by the government.

However, outside of these exceptions, the general policy of automatic extension will be completely eliminated.

According to USCIS Director Joseph Edlow, the measure seeks to “prioritize national security and the integrity of the immigration system” over administrative convenience.

“USCIS is placing a renewed emphasis on comprehensive background checks, eliminating policies that prioritized the convenience of foreign nationals over the safety of Americans,” he said.

The government also argues that this decision will allow for more frequent identification of individuals with criminal records or who may be subject to deportation before they obtain or renew an employment permit.

Potential impacts for immigrants and employers

For immigrants living and working legally in the United States, this decision could have immediate consequences.

Without the automatic extension, those who face delays in the approval of their renewal risk temporarily losing their job or income until they receive the new document.

Migrant rights organizations and immigration lawyers warn that the measure could aggravate the employment instability of thousands of Hispanic families who depend on these permits to keep their jobs.

In addition, employers could face disruptions in their operations if they are unable to legally retain workers who are current on their application but without final approval.

Immigrants planning to renew their work permit should apply as early as possible.

In addition, they should check whether their category is eligible for a specific extension and consult official USCIS sources to confirm updated processing times.

The elimination of the automatic extension marks a new twist in immigration policy under the Trump administration, which seeks to exert tighter control over immigration and labor processes, even for those with temporary legal status.
