In recent months, there has been a reported increase in cases of immigrants arrested during their scheduled appointments with immigration authorities at ICE or USCIS offices.

This situation has generated concern among migrant communities, immigration lawyers and human rights organizations, who warn about the risk that some people run by showing up for their interviews without the proper legal preparation.

According to several reports, these arrests occur primarily when the immigrant has a final order of deportation, an outstanding criminal record, or prior unresolved immigration violations.

In many cases, people are unaware of their full legal status or assume that attending their appointments automatically protects them from arrest.

“It is important to understand that showing up for an appointment does not guarantee immunity. If there is a prior deportation order or if ICE deems there is a risk to public safety, they can proceed with detention,” explained New York-based immigration attorney Laura Jimenez.

In the midst of this trend, experts recommend taking several precautions before attending any immigration appointment:

1. Consult with an immigration attorney

Before attending any interview or appointment with ICE or USCIS, it is recommended that you consult with a qualified attorney. A professional will be able to review the immigration history and verify if there is an active deportation order or if there is a risk of detention.

2. Review your immigration history

Many people are unaware that they have an outstanding deportation order, especially if they did not receive proper notifications. It is possible to request a copy of your immigration (FOIA) file to find out your legal status.

3. Do not go alone

In case you have to appear at a mandatory appointment, it is advisable to be accompanied by a lawyer or a trusted person who can act as a witness and contact family members or a lawyer if an arrest occurs.

4. Prepare an emergency plan

When faced with the possibility of arrest, it is advisable to have a family plan that includes who to contact, who will care for the children and how to access important documents.
