Trump Administration May Require Ankle Monitors for All Immigrants in Proceedings

The debate over criminalization and civil rights is reopened

In a move that has generated concern and alarm among immigration activists and lawyers, sources close to Donald Trump’s administration claim that a policy is being prepared to place electronic shackles (ankle monitors) on all immigrants who are in immigration proceedings, regardless of their criminal history or the progress of their case.

The revelation came during a recent edition of El Sargento’s podcast, which addressed the growing pressure by Immigration and Customs Enforcement(ICE) to keep immigrants under constant surveillance. According to the source consulted on the program, the proposal would seek to apply electronic shackles even to people with open cases, without criminal records and with years living in the country.

The justification behind this possible policy would be to reduce the “flight risk”.

Even in cases where immigrants are already voluntarily appearing for their immigration hearings or have active asylum applications.

Legal experts have warned that the widespread use of electronic shackles – technology commonly associated with paroled criminals – can be considered a form of symbolic criminalization of the immigrant.

In addition, it limits their freedom of movement, affects their daily life, and can lead to social stigmatization.

Although the policy has not yet been officially announced, it would not be the first time that electronic surveillance has been implemented on a massive scale.

During his first term, President Trump promoted the “Alternatives to Detention” program, which included electronic shackling, automated voice calls and GPS monitoring.

In many cases, women with minor children and workers with no prior history ended up with devices on their ankles indefinitely.

Currently, human rights organizations such as the ACLU and the National Immigrant Justice Center have denounced that these types of practices violate basic rights.

In addition to making immigrants easy targets for extreme surveillance policies.

Lawyers consulted by QuéOnnda explain that no immigrant is obliged to accept a shackle without an official order and that an immediate judicial review can be requested.

In many cases, judges have determined that the use of the device was excessive or unnecessary.

If you or someone you know is in the immigration process, it is important:

Document any written order ICE issues.
Do not sign anything without reading and consulting with an attorney.
Keep all immigration appointments on time.

The issue is still under development. QuéOnnda will continue to follow up and update this information as this policy is officially confirmed or rejected.
